1. General
1.1 The website www.jetseters.com (the “Website”) belongs to “MariosDermatis”, a private company legally seated in Marathonas, Greece, 5 Souliou Str., 19007 (the “Company”, “Jetseters” or “We”). Jetseters is a charter broker and only acts as an intermediary between third-party aircraft operators (the “Operators”)and users (“You”). Jetseters arrange carriage by air by chartering aircraft from the Operators on behalf of you. Jetseters does not itself provide transportation services.
1.2 These Terms and Conditions (the “Terms”) govern the access to and use of the Website. By using the Website by any means, you accept these Terms. We kindly request you to read these Terms carefully. The Terms constitute a legally binding agreement (the “Agreement”) between you and Jetseters. They apply in full force as if they were in writing. If you do not agree to these Terms, you should not use the Website. You must be eighteen or over to accept these Terms. By agreeing to these Terms, you represent and warrant that you have the authority, right and capacity to enter into this Agreement and to abide by all of the Terms and Conditions of the Agreement.
2. Intellectual Property Rights
2.1 The Website is intellectual property of the Company according to the applicable Greek and European intellectual property laws as well as to international conventions signed by Greece.
2.2The Company owns exclusively any intellectual property rights on the design, source code, and the entire content of the Website (including but not limited to data, images, layout, graphics, photographs, videos, texts, articles, sounds, written and other materials) either directly as creator or indirectly, licensed by the respective creators. You agree that any content of the Website, as described above, shall not be, indicatively and non-exclusively, copied, reproduced, modified, recorded, published, distributed or exploited by any means. You are not authorized to modify, adapt, disassemble, or decompile the Website’s software by any means.
2.3 Any trademarks, brand names, and logos appearing on the Website are either registered trademarks of the Company or by third parties. They enjoy protection under the Greek and European applicable laws and under international conventions and treaties. In any event, the use of these trademarks, brand names, and logos without a license is absolutely prohibited.
2.4 Violation of the above-mentioned terms by any means shall draw the subsequent penalties and liability foreseen by applicable laws.
3. Processing of Personal Data
The processing of your personal data is carried out in accordance with the Privacy Notice and Cookies Notice.
4. Services
4.1 Private Jet rental
You can request a flight quote by filling out the requested information (departure airport, destination airport, date, number of passengers, full name, phone number,etc.)in the form available on the Website. As soon as we aggregate all available flight quotes, we provide you with information about all available quotes, Operators, costs, etc. If you wish to book a certain flight, you either contact the Operator directly and book the flight or we book such flight on your behalf. Such direct or indirect communication depends on each Operator’s policy.
4.2 Air ambulance
We also arrange air ambulance, medevac, or medical transportation services. To this end, we offer a rapid 24-hour response service. As soon as we aggregate all available flight quotes according to your specific request, we provide you with information about all available quotes, Operators, costs, etc. If you wish to book a certain service, you contact the Operator directly.
5. Use of the Website
You may access and use the Website only in order to make legitimate requests to book, through Jetseters, services offered by the Operators. Your requests through our Website’s forms or via phone shall not be speculative, false, or fraudulent. You shall not submit requests under a false name or by use of any other fraudulent information. Please note that fraudulent users may face civil and criminal liability, depending on applicable law.You shall not use the Website to submit Requests in the name and/or on behalf of third parties unless you are legally authorized to do so.
6. No Warranty– Exclusion/Restriction of Liability
6.1 The content of the Website is offered ‘as is’, with no guarantee, explicit or implied, of any kind in relation to its commercial use or its suitability for any specific purpose explicit guarantee is given that the pages, services, features, options and contents of the Website will be provided without interruption or errors, or that any errors will be corrected. Despite our efforts, there is no guarantee that the Website does not contain any harmful content.
6.2 Under no circumstances, including that of negligence, shall we or our representatives be held liable for any form of loss or damage sustained by the user of the services and content of the Website, use of which he/she makes entirely and solely at his/her own initiative and responsibility. Although we aim to meet the highest industry standards through our services, neither we nor our partners shall be held liable for any inaccuracy or misleading information provided on our Website.
6.3Jetseters does not itself provide transportation services. These Terms are not a contract for transportation and no such contract is or will be entered into between you and Jetseters. Jetseters shall not bear any obligation or liability in relation to any subsequent carriage agreements you enter into (in particular for any injury, damage, death, loss, accident, or delay due to any action or omission of the Operators or any other third parties in connection with any carriage agreements). Any potential carriage agreement is entered into between you and the Operators. You should read each Operator’s Policy or Terms regarding cancellations and refunds, extra charges, luggage weight, and dimensions limitations, aircraft changes, customers or aircraft delays, etc.
7. Indemnification
You agree to indemnify Jetseters, its partners or representatives, and any other person (including any Operator) against any direct or indirect damage (including reasonable attorneys’ fees) that may result out of or in connection with any breach by you of these Terms (including any representation or warranty by you herein), any other agreement or any applicable laws or regulations or relating to your actions or omissions for, in the name and/or on behalf of any third party, including your failure to inform such third parties of, or cause them to comply with, all terms and conditions applicable to services acquired through the Website.
8. Links to Third Party Websites
8.1 The Website may contain links or hyperlinks to other websites, which are controlled by third parties. Under no circumstances, shall we or our representatives be held liable for the content of such websites, nor for any financial or other form of loss or damage suffered by a viewer visiting such sites. Under no circumstances shall we or our representatives guarantee that these links will operate without interruption.
8.2 These external links are indicative and not exclusive. We reserve the right to remove or add links without notice, and to change the content of the Website at any time. The user acknowledges that under no circumstances shall we or our representatives be held liable for the content of the links or hyperlinks it contains, the services/products they may offer, or the advertisements they may display.
9. Miscellaneous
9.1 These Terms constitute the entire agreement between you and Jetseters and supersede any prior or contemporaneous understandings or agreements (whether oral or written) regarding the subject matter.
9.2 It is agreed that all the above Terms are of equal substance. If any provision of the above is contrary to the law, it shall automatically cease to apply and shall be removed, without affecting in any way the validity of the other Terms.
10. Governing Law and Jurisdiction
10.1 These Terms, and any amendment thereof, are governed and shall be construed under and in accordance with the Greek law, European Union law, and international conventions to which Greece is a signatory.
10.2 Any action arising out of or pertaining to these Terms shall be initiated and maintained in the courts of Piraeus, Greece
11. Amendment of Terms & Conditions
Jetseters reserves the right to amend these Terms in accordance with its own needs and in compliance with the applicable laws at any time. We encourage you to occasionally visit this page to get informed about any possible change. In the event of any subsequent amendment of these Terms, your use of the Website at a future date will be taken to imply your acceptance of the new Terms.
